
This area of the law concerns itself with decedents' estates, both with wills and without wills, guardianships of children and adult incompetents, and conservatorships of the estates of such persons. While some probate court actions are adversarial in nature the great bulk of them are administrative.
Other important areas of probate practice are concerned with interpretation of wills and trusts and the reformation of trusts. A will contest, that is litigation to determine the validity of a will, is also the province of the probate practitioner.
Probate practitioners are usually estate planning attorneys as well.
