Individuals and families sometimes have specific charitable goals which can be best realized by the creation of a private foundation that they can fund and guide. Organizations or other public entities sometimes have charitable goals which can be best realized by the creation of a public charity or supporting organization. Such organizations receive their funding from private foundations, other public charities, the government, and/or the general public. Setting up these entities requires not only the creation of a non-profit corporation with all its attendant documents and filings but the qualification of the organization with the IRS and the State Attorney General's office. Subsequent to the formation and qualification of a charity the emphasis of the organization may shift and it may become necessary to draft amendments to the organic documents and secure requalification of the organization. Organizations of some vintage that were set up under a will or revocable trust require reformation under probate court proceedings.
